1. Introduction & Scope
These Terms & Agreement (“Terms”) govern the non-medical home care services provided by Lending Hands CGS (“we,” “us,” or “our”) to clients and their authorized representatives (“you” or “Client”) in the State of California.
By requesting, accepting, or paying for services, you agree to these Terms. If you do not agree, please do not use our services. These Terms may be updated from time to time; the current version is posted at lendinghandcgs.com/terms.
2. Non-Medical Home Care Services Only
Lending Hands CGS provides non-medical home care, companionship, and personal assistance. We do not provide skilled nursing, medical treatment, physical therapy, occupational therapy, speech therapy, or any service that requires a professional license under California law.
Examples of services we may provide include:
- Assistance with activities of daily living (bathing, dressing, grooming, toileting, mobility, feeding)
- Companionship, social engagement, and supervision
- Meal preparation, light housekeeping, laundry, and errands
- Medication reminders (we do not administer, inject, or dispense medications)
- Transportation and appointment accompaniment
- Recovery support following illness or surgery, as directed by your medical provider
- Respite and family support
We will not perform tasks that exceed the scope of non-medical home care. If a Client’s needs become medical or skilled in nature, we will recommend that the Client contact an appropriate licensed professional.
3. No Medical Advice or Treatment
Our staff are not medical professionals. Nothing we say or do constitutes medical advice, diagnosis, or treatment. We do not make health-related decisions for Clients. Any health concerns, medication changes, or emergency situations must be directed to a physician, nurse, emergency medical services (911), or other qualified professional.
4. Medication Reminders
California law permits non-medical home care aides to provide medication reminders only. This means we may:
- Remind the Client that it is time to take prescribed medication
- Hand the Client a pre-poured or pre-packaged medication that the Client or authorized person has prepared
- Observe to confirm the Client has taken the medication, if requested
We may not:
- Administer injections, IV medications, or nebulizer treatments
- Crush medications, measure doses, or determine what medications to give
- Apply prescription eye, ear, or skin medications
- Manage medication regimens or interpret physician orders
5. California Licensing & Registration
Lending Hands CGS operates in compliance with the California Home Care Services Consumer Protection Act (Health and Safety Code §§ 1726 et seq.) and regulations enforced by the California Department of Social Services (DSS).
Our home care aides are registered with the California Caregiver Registry as required by law. We conduct background screening, including fingerprinting through the California Department of Justice (DOJ) and FBI where applicable, and maintain required bonds and insurance.

6. Care Plan & Authorization
Before services begin, we will prepare a written care plan based on information you provide. You or your authorized representative must review and approve the plan. The plan describes the services to be provided, schedule, fees, and any special instructions.
You agree to provide accurate, complete, and current health, mobility, and household information. You must inform us promptly of any changes that could affect safety or care, including falls, hospitalizations, new medications, infectious conditions, or behavioral changes.
7. Client Rights (California)
As a California consumer of home care services, you have the right to:
- Receive a written notice of these rights and the services to be provided
- Be treated with dignity, respect, and without discrimination
- Receive services from aides who have met California registration and background-check requirements

- Receive clear information about fees, billing, and payment policies
- Confidential treatment of your personal and health information
- File a complaint with us and, if needed, with the California Department of Social Services

8. Fees, Billing & Payment
Fees for services are described in the written care plan or service agreement provided before care begins. Rates are based on the type of service, schedule, and level of care needed.
- Payment is due according to the billing schedule you agree to (e.g., weekly, biweekly, or monthly).
- We accept the payment methods disclosed at intake.
- Returned payments, late payments, or cancellations outside our policy may incur additional fees.
- We do not bill Medicare, Medi-Cal, or private insurance unless a specific arrangement has been made in writing.
9. Cancellations & Schedule Changes
We understand plans change. Cancellations or schedule changes must be made at least 24 hours in advance when possible. Cancellations made with less notice may be billed at the scheduled rate. We reserve the right to discontinue services for repeated last-minute cancellations, unsafe conditions, non-payment, or behavior that endangers staff.
10. Limitation of Liability
To the fullest extent permitted by California law, Lending Hands CGS is not liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to our services.
Our total liability for any claim related to services rendered is limited to the amount paid for the specific services giving rise to the claim during the 30 days preceding the event.
Nothing in these Terms limits liability for gross negligence, willful misconduct, fraud, or unlawful discrimination.
11. Insurance & Indemnification
We maintain general liability insurance and workers’ compensation insurance as required by California law. You agree to notify us immediately of any incident that could give rise to a claim and to cooperate in the investigation.
You agree to indemnify and hold harmless Lending Hands CGS and its caregivers from claims arising from your failure to disclose material information, your property conditions, or the acts of third parties in the home.
12. Privacy & Confidentiality
We respect your privacy. Personal information collected during intake, scheduling, and care is used only to provide and improve our services. We do not sell your personal information.
